These Terms of Use (“Terms”) apply to the Apex Mini Map mobile application (“Apex” or the “App”), provided by CK Design & Development, LLC (“CKD&D,” “we,” “us,” or “our”).
By downloading, accessing, or using Apex, you agree to these Terms. If you do not agree, do not use the App.
If you obtained Apex through the Apple App Store, your license to use the App is also governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”).
These Terms supplement the Apple Standard EULA. They do not replace or limit any rights or obligations that cannot legally be modified. If these Terms conflict with the Apple Standard EULA regarding your license to the App, the Apple Standard EULA controls to the extent of that conflict.
Apple is not responsible for providing support or maintenance for Apex except as required by applicable law or Apple’s own terms.
Apex provides an arcade-style driving minimap that may display features such as:
Apex is a visual driving companion. It is not turn-by-turn navigation, a certified speedometer, a collision-avoidance system, an autonomous-driving system, or a substitute for your judgment.
You must not interact with Apex while operating a vehicle when doing so would distract you, interfere with safe vehicle operation, or violate applicable law.
You are solely responsible for:
Apex is not intended to encourage speeding, racing, aggressive driving, reckless driving, trespassing, or any other dangerous or unlawful conduct.
Stop using Apex immediately if it distracts you or interferes with your ability to drive safely.
Apex does not provide turn-by-turn directions and should not be relied upon to determine a safe or lawful route.
Apex does not guarantee that displayed information will identify:
Always follow actual road signs, traffic controls, official instructions, and observable road conditions rather than information shown in the App.
Any speed shown by Apex may be calculated using device-location or motion signals.
Displayed speed may be delayed, unavailable, or inaccurate because of signal quality, device placement, environmental conditions, hardware limitations, or other factors.
Apex is not a calibrated or certified speed-measurement instrument. Do not rely on Apex instead of your vehicle’s instruments or your obligation to obey posted speed limits.
Apex relies on your device, iOS Location Services, internet connectivity, and third-party map services.
Location and map information may be inaccurate, delayed, incomplete, unavailable, or inconsistent. Accuracy can be affected by:
We do not guarantee the accuracy, completeness, availability, or timeliness of location, map, road, speed, or fuel-station information.

In an emergency, contact the appropriate emergency service directly and follow official instructions.
You may use Apex only if you are legally permitted to enter into these Terms.
If you use Apex while operating a vehicle, you must be legally authorized to operate that vehicle and must use the App in compliance with all applicable laws.
If you are under the age of legal majority where you live, you may use Apex only with permission from a parent or legal guardian.
Subject to these Terms and the Apple Standard EULA, CKD&D grants you a limited, personal, revocable, nonexclusive, nontransferable license to use Apex on Apple-branded devices that you own or control, as permitted by applicable App Store usage rules.
No ownership interest in Apex is transferred to you.
You may not:
Apex, including its software, interface, graphics, visual style, branding, text, features, and original content, is owned by CKD&D or its licensors and is protected by applicable intellectual-property laws.
Map content, Mapbox technology, third-party trademarks, and other third-party materials remain the property of their respective owners.
No right to use the Apex name, logo, branding, or other trademarks is granted except as necessary to use the App normally.
Apex uses third-party products and services, including Mapbox, to provide map and location functionality.
Third-party services may be governed by separate terms and privacy policies. Their availability, accuracy, security, and functionality are outside our direct control.
We are not responsible for third-party services except to the extent responsibility cannot legally be excluded.

We do not guarantee that Apex will always be available, compatible with every device, or supported indefinitely.
You may need to install updates to continue using the App.
If you voluntarily submit suggestions, ideas, or other feedback about Apex, you grant CKD&D permission to use that feedback without restriction or compensation to you.
This does not transfer ownership of personal information contained in a support request.
To the maximum extent permitted by law, Apex is provided “as is” and “as available.”
CKD&D disclaims all express, implied, and statutory warranties, including warranties of:
We do not warrant that Apex will be uninterrupted, error-free, accurate, complete, secure, or suitable for any particular driving situation.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
To the maximum extent permitted by law, CKD&D and its owners, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to Apex.
This includes, without limitation, losses arising from:
To the maximum extent permitted by law, CKD&D’s aggregate liability arising from Apex will not exceed the greater of:
Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or other liability that applicable law prohibits us from excluding.
You may stop using Apex at any time by deleting the App.
We may suspend or terminate your permission to use Apex if you materially violate these Terms, misuse the App, threaten the security or operation of the App, or use the App unlawfully.
Upon termination, the license granted to you ends, but provisions that by their nature should survive will remain effective.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection rights that apply where you live, disputes relating to these Terms or Apex will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
Nothing in this section deprives you of consumer rights or legal protections that cannot be waived under the laws of your place of residence.
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
A failure to enforce any provision of these Terms is not a waiver of the right to enforce it later.
We may update these Terms to reflect changes to Apex, third-party services, or legal requirements.
When we make changes, we will update the effective date above. Material changes may also be communicated through the App or another appropriate method.
Your continued use of Apex after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
